General Terms and Conditions (GTC)

§ 1 Scope

These General Terms and Conditions apply to all orders placed by consumers through the online shop at casabrasil.berlin with Casa Brasil GmbH, Husemannstraße 29, 10435 Berlin (hereinafter referred to as "we"). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (§ 13 BGB).

§ 2 Conclusion of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the purchase button in the final step of the ordering process, you submit a binding offer to purchase the goods contained in your shopping cart. Confirmation of receipt of the order is sent immediately by email after the order has been submitted. The purchase contract is concluded when we send our order confirmation by email or, at the latest, when the goods are shipped.

The contractual language is German. We do not store the contract text and it can no longer be accessed after completion of the ordering process; you will receive the order details together with the order confirmation by email.

§ 3 Prices and shipping costs

All prices are stated in euros and include the applicable statutory VAT, plus shipping costs. Shipping costs are based on the weight of the order and are displayed on the "Shipping & Payment" page as well as during the ordering process. We offer free shipping within Germany for orders with a value of 69 € or more.

§ 4 Minimum order value and maximum weight

The minimum order value is 20 € and applies to all orders, including orders for in-store pickup. Orders containing at least one frozen product are available for in-store pickup only. The maximum weight is 10 kg per order.

§ 5 Payment

Payment can be made by credit or debit card, Apple Pay, Google Pay or PayPal. The purchase price is due upon conclusion of the contract.

§ 6 Delivery and pickup

We deliver exclusively within Germany using DHL. Orders are generally shipped within 1 business day after receipt of the order; delivery thereafter generally takes 1-2 business days. Alternatively, you can pick up your order free of charge from our physical store (Husemannstraße 29, 10435 Berlin); pickup is generally available within 1 business day, and you will receive a notification.

§ 7 Retention of title

The goods remain our property until payment has been made in full.

§ 8 Right of withdrawal

Consumers are entitled to the statutory right of withdrawal. For further details, including exceptions for goods that are liable to deteriorate rapidly and sealed goods, please refer to the "Right of Withdrawal" page.

§ 9 Statutory warranty

The statutory rights relating to liability for defects apply.

§ 10 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

§ 11 Final provisions

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence. If individual provisions of these General Terms and Conditions are invalid, the validity of the remaining provisions shall remain unaffected.
