General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to all orders placed by consumers through the online shop at casabrasil.berlin with Casa Brasil GmbH, Husemannstr. 29, 10435 Berlin (hereinafter referred to as "we"). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (Section 13 BGB).

§ 2 Conclusion of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the purchase button in the final step of the ordering process, you submit a binding offer to purchase the goods contained in your shopping cart. Confirmation that the order has been received is sent by email immediately after the order is submitted. The purchase contract is concluded when we send our order confirmation by email or, at the latest, when the goods are dispatched.

The contract language is German. We do not store the contract text, and it can no longer be accessed after the ordering process has been completed; you will receive the order details with the order confirmation by email.

§ 3 Prices and shipping costs

All prices are stated in euros, including statutory value-added tax, plus shipping costs. Shipping costs are calculated according to the weight of the order and are displayed on the "Shipping & Payment" page and during the ordering process. Orders with a value of 99 € or more are delivered free of charge within Germany.

§ 4 Minimum order value and maximum weight

The minimum order value is 35 €. The maximum order weight is 10 kg per order.

§ 5 Payment

Payment may be made by credit or debit card, Apple Pay, Google Pay or PayPal. The purchase price becomes due upon conclusion of the contract.

§ 6 Delivery and collection

We deliver exclusively within Germany using DHL. Orders are dispatched twice a week; delivery usually takes 1-4 business days after dispatch. Alternatively, you may collect your order free of charge from our physical store (Husemannstr. 29, 10435 Berlin); collection is usually available within 1 business day, and you will receive a notification.

§ 7 Retention of title

The goods remain our property until payment has been made in full.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. For details, including the exceptions applicable to perishable and sealed goods, please refer to the "Instructions on withdrawal" page.

§ 9 Statutory warranty

The statutory rights concerning liability for defects apply.

§ 10 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).

§ 11 Final provisions

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence. If any individual provision of these General Terms and Conditions is invalid, the validity of the remaining provisions shall remain unaffected.
