Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, take possession of the goods. If several goods from a single order are delivered separately, the period begins on the day on which the last item is received.

by means of a clear statement, for example a letter sent by post or an email, informing us of your decision to withdraw from this contract. You may use the model withdrawal form provided below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us. The reimbursement will be made without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for the reimbursement as you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You shall bear the direct cost of returning the goods.

In the case of defective goods, goods damaged during transport, or goods delivered incorrectly, Casa Brasil will bear the return shipping costs and will provide a prepaid return label by email.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to the following contracts (§ 312g para. 2 BGB):

  • for the supply of goods that are liable to deteriorate or expire rapidly;
  • for the supply of sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery;
  • for the supply of goods that are not prefabricated and whose production depends on an individual choice or specification made by the consumer.
